CHAPTER XIV. TRAFFICCHAPTER XIV. TRAFFIC\Article 1. Standard Traffic Ordinance

There is hereby incorporated by reference for the purpose of regulating traffic within the corporate limits of the City of Sublette, Kansas, that certain standard traffic ordinance known as the “Standard Traffic Ordinance for Kansas Cities”, 49th Edition published in 2022, prepared and published in book form by the League of Kansas Municipalities, Topeka, Kansas, save and except such articles, section, parts or portions as are hereafter omitted, deleted, modified, or changed. No fewer than three (3) copies of said Standard Traffic Ordinance shall be marked or stamped “Official Copy as Adopted by Ordinance No. 463”, with all sections or portions thereof intended to be omitted or changed clearly marked to show any such omission or change and to which shall be attached a copy of this article or said ordinance, and filed with the City Clerk to be open to inspection and available to the public at all reasonable hours. The Police Department, Municipal Judge, and all Administrative Departments of the City charged with enforcement of the ordinance shall be supplied, at the cost of the City, such number of official copies of such Standard Traffic Ordinance similarly marked, as may be deemed expedient. The Standard Traffic Ordinance currently adopted by the City shall be amended or supplemented, as the case may be, by all other sections of this article regardless of whether such other sections were adopted before or after the current Standard Traffic Ordinance.

(b)   Ordinance No. 289-Passed September 10, 1990, titled: “AN ORDINANCE DECLARING CERTAIN MATTERS AS MOTOR VEHICLE NUISANCES WITHIN THE CITY OF SUBLETTE, KANSAS; PROVIDING FOR THE REMOVAL OR ABATEMENT OF MOTOR VEHICLE NUISANCES; AUTHORIZING THE ASSESSMENT OF COSTS AND PROVIDING FOR PENALITES.

(c)   Ordinance No. 299-passed June 7, 1993, titled; AN ORDINANCE DEFINING CARELESS DRIVING AND PROVIDING PENALTIES; THEREFORE, AND SUPPLEMENTING THE STANDARD TRAFFIC ORDINANCE.”

(d)   Ordinance No. 341-passed December 1, 2003, titled; “AN ORDINANCE REGULATING THE PARKING OF CERTAIN MOTOR VEHICLES, TRUCKS, TRAILERS, IMPLEMENTS, AND EQUIPMENT UPON ANY STREET, ALLEY, PUBLIC WAY, OR RIGHT OF WAY WITHIN THE CITY OF SUBLETTE, HASKELL COUNTY, KANSAS, AND PROVIDING PENAL TIES FOR VIOLATION THEREOF.”

(e)   Ordinance No. 364-passed June 1, 2010, titled; “AN ORDINANCE RESTRICTING, REGULATING, AND PROHIBITING CERTAIN PARKING AND DRIVING OF CERTAIN TRUCKS, TRACTORS, SEMI-TRAILERS, TRANSPORTS, BUSES, VANS, CAMPERS, TRAILERS, IMPLEMENTS, MACHINERY, EQUIPMENT, AND OTHER VEHICLES UPON ANY STREET, A VENUE, ALLEY, PUBLIC WAY OR RIGHT-OF-WAY WITHIN THE CITY OF SUBLETTE, HASKELL COUNTY KANSAS, AND PROVIDING PENALTIES FOR THE VIOLATION THEREOF.”

All previous ordinances, with the exception of those previously identified, relating to traffic in conflict with the provisions of the Standard Traffic Ordinance for Kansas Cities, and all ordinances incorporating earlier editions of the Standard Traffic Ordinances are hereby repealed. Any ordinance(s) regulating traffic or parts thereof not identified in the above list that is not in conflict with the Standard Traffic Ordinance for Kansas Cities remains valid.

(a)   An ordinance traffic infraction is a violation of any section of this article that prescribes or requires the same behavior as that prescribed or required by a statutory provision that is classified as a traffic infraction in K.S.A. 8-2118.

(a)   All traffic violations which are included within this article, and which are not ordinance traffic infractions, as defined in subsection (a) of this section, shall be considered traffic offenses.

The fine for violation of an ordinance traffic infraction or any other traffic offense for which the municipal judge establishes a fine in a fine schedule shall not be less than $10 nor more than $500 except for speeding which shall not be less than $10 nor more than $500. A person tried and convicted for violation of an ordinance traffic infraction or other traffic offense for which a fine has been established in a schedule of fines shall pay a fine fixed by the court not to exceed $500.
