1-801. Capital improvement fund.
(a) There is hereby created, for the City of Sublette, a special fund, to be known as the Capital Improvements Fund.
(b) The governing body of the City is hereby authorized to transfer moneys from other city funds, lawfully available for improvement purposes, to the Capital Improvements Fund.
(c) Moneys in the capital improvements fund may be used to finance, in whole or in part, any public improvement need set forth in the adopted capital improvement plan, including the repair, restoration, and rehabilitation of existing public facilities. In addition, disbursement from the Capital Improvements Fund may be made for engineering and other advance public improvement plans and studies. Reimbursements may be made to the fund from bond proceeds, special assessments or state or federal aid available for the completed project. Except for such reimbursed expenses, no money shall be credited to the Capital Improvements Fund except as may be budgeted annually, or transferred by the annual budget from other funds.

(a) FUND CREATED. The City hereby creates a new fund and titles the same the Sublette Airport Fund.
(b) FUNDING OF THE SUBLETTE AIRPORT FUND. Property taxes are obtained from the property taxes on the airplane, N400BK, owned by Cattle Empire. These taxes are allocated between different entities within Haskell County; Haskell County itself realizes tax revenues. Said taxes obtained can be allocated to said fund at the discretion of the Haskell County Commission. These amounts, if any, will be transferred from the county directly to said fund.
(c) PURPOSE. The funds, if any, placed into said account shall be used solely for costs relating to the Sublette Municipal Airport. The purpose of this resolution is to ensure that there are funds available to maintain an adequate facility for the operation of the Sublette Municipal Airport. This will further ensure that Cattle Empire continues to house its plane in the Sublette Municipal Airport, thereby providing property tax revenues to different entities in Haskell County.
(d) EXPENSES AUTHORIZED. Costs authorized to be paid from said fund shall include normal maintenance, upkeep of the airport, building and maintenance of airport facilities, and creating and maintenance to runways. Only costs specifically included in this section are authorized to be paid out of said fund.
(e) PRIOR APPROVAL OF COUNTY REQUIRED FOR CERTAIN EXPENSES. In the event there are additional costs or projects regarding the airport which are not specifically included in Section 3, then the City must obtain the Haskell County Commissioner’s approval prior to using any monies allocated by the county into said fund.
(f) ACCOUNTING. At the request of the Haskell County Commission the City Clerk shall provide an accounting of the fund within 14 days of receipt of such request.

At the General election held on the 2nd day of November, 2010, a majority of the electors voting thereon approved the levying of an increased retailer’s sales tax in the City of Sublette, Kansas, as authorized by K.S.A. 12-187 et seq., as amended, and by virtue thereof there is hereby levied a city retailers’ sales tax in the amount of one and one-quarter percent (1.25%) to take effect of the 1st day of April, 2011.
