A CHARTER ORDINANCE EXEMPTING THE CITY OF SUBLETTE, KANSAS, FROM THE PROVISIONS OF K.S.A. 79-5028, AS AMENDED BY 1990 HOUSE BILL NO. 2700, AND PROVIDING SUBSTITUTE AND ADDITIONAL PROVISIONS ON THE SAME SUBJECT.
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF SUBLETTE, KANSAS:
Section 1. The City of Sublette, by the power vested in it by Article 12, Section 5 of the Constitution of the State of Kansas and as provided by K.S.A. 79-5036(a), as amended by 1990 House Bill No. 2700, hereby elects to exempt itself from the provisions of K.S.A. 79-5028, as amended by 1990 House Bill No. 2700. K.S.A. 79-5028, as amended, is part of an enactment commonly known as the Kansas property tax lid law, which enactment applies to this city but does not apply uniformly to all cities.
Section 2. The following is hereby substituted for the provisions o f K. S. A. 79- 5028, as a mended: The provisions of K.S.A. 79-5021 to 79-5035, inclusive, and amendments thereto, shall not limit the levy of taxes by the Governing Body of the City of Sublette.

RESOLUTION NO. 020189
WHEREAS, by affirmative vote of the governing body on July 4, 1990, Charter Ordinance Number 8 was passed by the governing body and pursuant to law said Ordinance was published on June 14 and June 27, 1990;
WHEREAS, Petitions signed by a number of electors exceeding 10 percent of the number of electors voting at the last preceding regular city election demanding a referendum of the said Charter Ordinance have been filed with the City Clerk pursuant to Article 12, Section 5 (3) of the Kansas Constitution; and
WHEREAS, the need anticipated in the adoption of Charter Ordinance Number 8 has not materialized and it is not to the best interest of the City to incur the expense of an election on the enactment of Charter Ordinance Number 8 and the adoption thereof should be rescinded and no election should be called upon the taking effect thereof.
NOW, THEREFORE, BE IT RESOLVED that the actions of the governing body of the City of Sublette, Kansas, in adopting Charter Ordinance Number 8 on the 4th day of July, 1990, be and the same is hereby rescinded and said Charter Ordinance shall not be enacted or take effect as by law required and an election on such proposition shall not be called.
