(a)   The charge to be made and collected by the City of Sublette, Kansas, for all water produced, distributed, sold and used by all persons within the said City of Sublette, shall be calculated and charged at the following rates of consumption:

(1)   A minimum charge of $10.00 for the first 2,000 gallons, or any portion thereof per month; per dwelling unit, business, or taxing entity.

(2)   $1.25 per 1,000 gallons in excess of the minimum allowance of 2,000 gallons and up to 5,000 gallons of usage per month; per dwelling unit, business, or taxing entity.

(3)   $1.50 per 1,000 gallons for all water usage over 5,000 gallons per month and up to 10,000 gallons per usage per month; per dwelling unit, business, or taxing entity.

(4)   $1.75 per 1,000 gallons for all water usage over 10,000 gallons per month and up to 25,000 gallons per usage per month; per dwelling unit, business, or taxing entity.

(5)   $2.00 per 1,000 gallons for all water usage over 25,000 gallons per month and up to 50,000 gallons per usage per month; per dwelling unit, business, or taxing entity.

(6)   $3.00 per 1,000 gallons for all water usage over 50,000 gallons per month and up to 100,000 gallons per usage per month; per dwelling unit, business, or taxing entity.

(7)   $4.00 per 1,000 gallons for all water usage over 100,000 gallons per month; per dwelling unit, business, or taxing entity.

(b)   The charge to be made and collected by the City of Sublette, Kansas, for all water produced, distributed, sold and used by all persons outside of the city limits of Sublette shall be calculated and charged at the following rates of consumption:

(1)   A flat set rate of $20.00 per month per dwelling unit, business, or taxing entity hooked up to a City water meter regard less of amount of water usage.

(2)   $2.50 per 1,000 gallons and up to 5,000 gallons per month; per dwelling unit, business, or taxing entity.

(3)   $3.00 per 1,000 gallons for all water usage over 5,000 gallons per month and up to 10,000 gallons per usage per month; per dwelling unit, business, or taxing entity.

(4)   $3.50 per 1,000 gallons for all water usage over 10,000 gallons per month and up to 25,000 gallons per usage per month; per dwelling unit, business, or taxing entity.

(5)   $4.00 per 1,000 gallons for all water usage over 25,000 gallons per month and up to 50,000 gallons per usage per month; per dwelling unit, business, or taxing entity.

(6)   $6.00 per 1,000 gallons for all water usage over 50,000 gallons per month and up to 100,000 gallons per usage per month; per dwelling unit, business, or taxing entity.

(7)   $8.00 per 1,000 gallons for all water usage over 100,000 gallons per month; per dwelling unit, business, or taxing entity.

The rate and charge made and collected by the City of Sublette, Kansas, for all water distributed through the City two inch water loading dock, for private use, shall be $500.00 per 1,000 gallons.

No person shall establish or permit to be established or maintain or permit to be maintained, any cross connection whereby a private, auxiliary, or emergency water supply other than the regular public water supply of the city may enter the supply and distributing system of the city unless specifically approved by the Kansas Department of Health and Environment and the governing body.

Approved devices to protect against backflow or backsiphonage shall be installed at all fixtures and equipment where backflow and/or backsiphonage may occur and where there is a hazard to the potable water supply in that polluted water or other contaminating materials may enter into the public water supply. Any situation in which a heavy withdrawal of water, such as a sudden break in the main or water being used from a fire hydrant, may cause a negative pressure to develop which could lead to backsiphonage of polluted water into the system shall be improper and must be protected by approved backflow preventive valves and systems as determined by the superintendent.

The city utility superintendent or other designee of the governing body shall have the right of entry into any building or premises in the city as frequently as necessary in his or her judgment in order to ensure that plumbing has been installed in accordance with the laws of the city so as to prevent the possibility of pollution of the water supply of the city.

Pursuant to the city’s constitutional home rule authority and K.S.A. 65-163a, the city by its utility superintendent may refuse to deliver water through pipes and mains to any premises where a condition exists which might lead to the contamination of the public water supply system and it may continue to refuse the delivery of water to the premises until that condition is remedied. In addition, the city utility superintendent may terminate water service to any property where the cross connections or backsiphonage condition creates, in the judgment of the superintendent, an emergency danger of contamination to the public water supply.

There is hereby incorporated by reference for the purpose of regulating cross connections between the public water supply and any sources of contamination that certain manual adopted by the Governing Body of the City of Sublette known as “MANUAL OF REGULATIONS REGULATING BACKFLOW AND BACKSIPHONAGE OF CONTAMINANTS DUE TO CROSS CONNECTIONS FOR THE CITY OF SUBLETTE PUBLIC WATER SUPPLY.” No fewer than three copies of said manual shall be marked or stamped “OFFICIAL COPY AS ADOPTED BY ORDINANCE NO. 295,” and to which shall be attached a copy of said ordinance, or this code section, and filed with the City Clerk to be open to inspection and available to the public at all reasonable hours.
