The parking, placing, or leaving unattended of any of the vehicles or equipment as described in this section for more than one (1) hour on any street, alley, public way, or right-of-way within the City of Sublette, Kansas is hereby determined to constitute a nuisance, a hazard to the general welfare of the citizens of Sublette, a dangerous condition, an obstruction to the safe use of the city streets and public right-of-way, an obstruction to the use of city equipment and emergency equipment, an attractive nuisance to children, and cause of damage to the roadway surface, and is, therefore, prohibited, to-wit:

(a)   Any type of truck, semi-trailer, trailer transport, trailer whether connected or not connected to a truck, bus, or any other motor vehicle or combinations thereof having a rating capacity of, or actual weight of, greater than 12,000 pounds G.V.W.

(b)   Any farm, industrial, or commercial vehicles, implements, machinery, or equipment, or any trailer, subject to the exceptions in this article.

(c)   Any abandoned or inoperable vehicle. Abandoned or inoperable is defined as any form of automobile, truck, trailer, tractor, motorcycle, bus, van, or any other type of vehicle which is junked, wrecked, inoperable, incapable of moving on its own power, missing parts prohibiting it from being moved, on jacks or blocks, not having a current registration plate on said vehicle, or absent any part of the vehicle necessary for the lawful operation of the vehicle.

(d)   EXCEPTIONS: Recreation vehicles, campers, camp trailers, and trailers (excluding any trailer which has been or is being used to transport livestock) which provides services to residents of Sublette, Kansas shall be exceptions to this article, provided the owner shall not park such on streets, alleys, or public right-of-ways for more than three (3) consecutive days. PROVIDED, however, nothing in this subsection (d) shall permit the parking of any trailer which has been or is being used to transport livestock on any street, alley, public way, or right-of-way within the City of Sublette, Kansas for more than one hour in any twenty-four (24) hour period.

Penalty for violation of section 14-501 shall be a fine in an amount not to exceed $500.00 or imprisonment not to exceed 30 days, or both. Each day during, or on which, a violation occurs or continues, shall constitute an additional or separate offense.

In addition to, or as an alternative to, charging a person for a violation of section 14-501, the law enforcement officer or agency servicing the city may remove the unattended or abandoned vehicle, truck, trailer, implement, or equipment, or personal property described in section 14-501 from the street, alley, or public-way of Sublette, after the one hour period of violation; or immediately if the property interferes with normal city, street, alley, or public-way operations; and the officer may impound the property and dispose the same pursuant to the current Kansas statutory law regarding abandoned vehicles on public highways, which is currently set out in K.S.A. 8-1101 to 8-1108, et seq., as amended. The property impounded shall not be returned to the owner until all towing charges, impoundment fees, storage fees, costs, and expenses are paid in full to the City Clerk.
