CHAPTER VII. FIRECHAPTER VII. FIRE\Article 2. Fire Limits

It is the purpose of the City of Sublette, Kansas to protect the City at large, its citizens and all property owners within the fire district from unsafe building construction, building construction susceptible to fire and preventing certain use of real property within the Fire District No. 1.

Fire District No. 1 shall consist of all of Blocks 5, 6, 7 and 8, and the East half of Block 4, and the West half of Block 9, Original Town, Sublette, Haskell County, Kansas.

The following types of construction of buildings or uses of real property within Fire District No. 1 are specifically prohibited:

(a)   Buildings of all wood construction;

(b)   Wood frame buildings without incombustible material outer surfacing;

(c)   Temporary structures of any type;

(d)   Trailers, trailer homes, mobile homes;

(e)   Grain elevators;

(f)    Any type of structure more than 55 feet in height;

(g)   Any building with any wood burning type of heating system.

All persons, firms or corporations desiring to change the use of their real property or improvements thereon within Fire District No. 1 or build new construction on their real property within Fire District No. 1 shall first apply to the City of Sublette for approval by submitting a written copy of their intended use plan or building construction plan to the City Commission at a regular City Commission meeting. The City may deny approval in the event the new use or new construction is one of the types listed in section 7-203 or in the event the City determines the use or structure to be unsafe, a fire hazard, a structure susceptible to fire or a use or structure which will create any form of nuisance or endangerment to the other properties in Fire District No. 1, the City at large, or its citizens. All plans submitted shall include:

(a)   Intended use of property;

(b)   Legal title owners of property;

(c)   Dimensions of buildings and/or improvements;

(d)   Lot size;

(e)   Type of construction material to be used in framing, walls, insulation and roof;

(f)    Type of heating and cooling system.
